Terms and Conditions

1. Seller Information and Definitions

  1. These terms and conditions govern the rules for using the online store operating at: https://globtos.nfinity.pl, run by: GLOBTOS Spółka z ograniczoną odpowiedzialnością (GLOBTOS Limited Liability Company), with its registered office at ul. Legnicka 60D, 54-204 Wrocław, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0000739617, NIP: 8943130424, REGON: 380742856, with share capital of PLN 5,000.00.
  2. Matters not regulated by these Terms and Conditions shall be governed by Polish law, in particular: the Act of 23 April 1964 – Civil Code, the Act of 30 May 2014 on Consumer Rights, the Act of 18 July 2002 on the Provision of Electronic Services, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  3. Terms used in these Terms and Conditions have the following meanings:
    • Store – the online service available at https://globtos.nfinity.pl, operated by the Seller, through which the Customer may place Orders.
    • Seller – GLOBTOS Sp. z o.o., as the entity operating the online store and entering into sales contracts with Customers.
    • Customer – a natural person, legal person or organisational unit without legal personality but having legal capacity, using the Store, including a Consumer or Entrepreneur.
    • Consumer – a natural person performing a legal transaction not directly related to their business or professional activity.
    • Entrepreneur with Consumer Rights – a natural person entering into a contract directly related to their business activity, where the content of the contract indicates that it does not have a professional character for that person.
    • Goods / Product – a movable item or digital content offered for sale in the Store.
    • Electronic Service – a service provided electronically by the Seller to the Customer via the Store, in particular the ability to create an account, place an order or subscribe to a newsletter.
    • Order – a declaration of intent by the Customer aimed directly at concluding a Sales Contract with the Seller, submitted via the Store’s functionality.
    • Sales Contract – a sales contract within the meaning of the Civil Code, concluded at a distance between the Seller and the Customer via the online Store.
    • Terms and Conditions – this document setting out the rules for using the Store.

2. Preliminary Provisions

  1. The online store available at https://globtos.nfinity.pl is operated by: GLOBTOS Spółka z ograniczoną odpowiedzialnością, with its registered office at ul. Legnicka 60D, 54-204 Wrocław, Poland, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Wrocław-Fabryczna, 6th Commercial Division of the National Court Register, under KRS number: 0000739617, NIP: 8943130424, REGON: 380742856.
  2. The Terms and Conditions govern the rules for using the online store, including the conditions for placing orders, conditions for concluding distance sales contracts, principles of product delivery, payment methods, consumer rights to withdraw from a contract, and complaints procedures.
  3. The Store sells physical goods (e.g. equipment, devices, accessories) and may also offer digital content (e.g. files, software) and services (e.g. consulting, servicing, technical support) – in accordance with the current offer presented on the Store’s website.
  4. Information presented on the Store’s website, in particular product descriptions, prices and availability, does not constitute an offer within the meaning of the Civil Code, but an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.
  5. Sales contracts are concluded in Polish, in accordance with these Terms and Conditions, via the Internet, in the form of a distance contract.
  6. Placing an order in the Store is equivalent to acceptance of these Terms and Conditions. Acceptance of the Terms and Conditions is a condition for concluding a sales contract. The Customer is informed each time of the need to read and accept the Terms and Conditions before placing an order.

3. Electronic Services

  1. Through the Store, the Seller provides the Customer with services by electronic means within the meaning of the Act of 18 July 2002 on the Provision of Electronic Services.
  2. The following Electronic Services are available in the Store: an order form – enabling orders to be placed without creating an account; a customer account – providing access to order history, fulfilment statuses and user data editing; a contact form – enabling enquiries or messages to be sent to the Seller; a newsletter – enabling commercial information and offers to be received electronically (upon granting the relevant consent); and basket functionality – enabling products to be added and managed before placing an order.
  3. The provision of electronic services by the Seller is free of charge.
  4. The agreement for the provision of an electronic service is concluded at the moment the Customer begins using a given Store functionality (e.g. completing the order form, creating an account), is either one-off (e.g. order form) or ongoing (e.g. customer account, newsletter), and may be terminated at any time by the Customer, without giving a reason, by ceasing to use the service or submitting an appropriate request to the Seller.
  5. In order to use the electronic services, the Customer should meet the minimum technical requirements: a device with Internet access, a web browser supporting JavaScript and cookies, and an active email account (for functions such as the newsletter or order confirmations).
  6. The Customer is obliged to use the Store in a manner consistent with the law, good practice and the provisions of the Terms and Conditions, and to refrain from posting any unlawful content in the Store.

4. Order Placement Rules

  1. Orders may be placed in the online Store 24 hours a day, 7 days a week, except during technical and maintenance breaks announced on the Store’s website.
  2. Orders may be placed by creating and logging into a Customer account, or without registration – as a guest, after providing the necessary data for order fulfilment.
  3. To place an order, the Customer should: select the product or products available in the Store’s offer and add them to the basket; proceed to the basket and click “Proceed to checkout” or an equivalent button; complete the order form, providing the data necessary for order fulfilment (including first name, surname, delivery address, email, telephone number); select the preferred delivery method and payment method; read the Terms and Conditions and accept their content – acceptance is a condition for placing an order; and confirm the order by clicking the “Order and pay” button or another equivalent final confirmation message.
  4. After placing an order: the Customer receives an automatic order confirmation to the email address provided in the form; the sales contract is concluded upon the Customer’s receipt of confirmation that the order has been accepted for fulfilment by the Seller (a separate email); and until the Seller confirms acceptance of the order, the Customer may modify or cancel it by contacting the Customer Service Office directly.
  5. The Seller reserves the right to refuse to fulfil an order placed in breach of these Terms and Conditions, or an order in respect of which there are reasonable grounds to suspect dishonest, false or activity contrary to the Seller’s interests (e.g. false data, system abuse).
  6. All product prices displayed on the Store’s website are expressed in Polish zloty (PLN) and include VAT (23% rate), but do not include delivery costs, which are indicated separately at the order placement stage.

5. Prices, Payments and Delivery

  1. All product prices quoted in the Store are expressed in Polish zloty (PLN) and are gross prices – they include VAT at 23%.
  2. The product price displayed on the Store’s website at the time of placing an order is binding on the parties to the sales contract. The Seller reserves the right to change product prices, but such changes do not affect orders placed before they are introduced.
  3. Delivery costs (including transport, delivery and courier service charges) are indicated separately before placing an order and are added to the order value as a separate item.
  4. The Customer may choose from the following payment methods: online electronic payment via payment systems operated by operators indicated in the Store (e.g. PayU, Przelewy24, Stripe, Tpay – depending on the available configuration); traditional bank transfer to the Seller’s bank account; cash on delivery (if available); or other payment methods currently available in the order interface.
  5. In the case of electronic payments, order fulfilment will commence upon the Seller’s receipt of confirmation of the correct execution of the transaction from the payment operator.
  6. In the case of a traditional bank transfer, the Customer is obliged to make payment within 3 business days from the date of concluding the contract. If payment is not made within this period, the order may be cancelled.
  7. Deliveries are made within the territory of the Republic of Poland, and in the case of international shipments – only after individual agreement of terms with the Customer Service Office.
  8. The Seller offers the following delivery options: courier (e.g. DPD, InPost, FedEx, UPS – depending on configuration); InPost parcel locker; personal collection at the company’s registered office (if made available and active in the system); and other delivery options visible in the order system.
  9. The order fulfilment period is usually 1 to 5 business days, counted from the date the payment is recorded (or the transaction confirmed), unless a different period is indicated in the product description.
  10. Each order includes a proof of purchase (fiscal receipt or VAT invoice). When placing an order, the Customer may indicate a wish to receive a VAT invoice and provide the data necessary for its issuance.

6. Right of Withdrawal and Returns

  1. A Customer who is a Consumer or a so-called Entrepreneur with Consumer Rights has the right to withdraw from a contract concluded with the Seller at a distance without giving a reason and without incurring costs, except for the costs specified in section 8, within 14 calendar days from: the date on which the Customer or a third party indicated by the Customer (other than the carrier) takes possession of the goods; or, in the case of a contract covering multiple items delivered separately, from the date of taking possession of the last item.
  2. To exercise the right of withdrawal, the Customer must submit to the Seller an unambiguous statement of withdrawal from the contract. This statement may be sent electronically to the email address: [insert email address here], or by post to: GLOBTOS Sp. z o.o., ul. Legnicka 60D, 54-204 Wrocław.
  3. The Customer may use the model withdrawal form attached to these Terms and Conditions, although this is not mandatory.
  4. In the event of withdrawal from the contract, the contract is deemed not to have been concluded, and the Seller shall reimburse the Customer for all payments received, including delivery costs (except for costs arising from the Customer’s choice of a more expensive delivery method than the cheapest standard method offered by the Seller).
  5. The refund shall be made promptly, no later than 14 days from the date of receipt of the withdrawal statement, subject to section 7. The refund shall be made using the same payment channel used by the Customer, unless the Customer has explicitly agreed to a different solution.
  6. The Seller may withhold the refund until the returned goods are received or proof of their return is provided – whichever occurs first.
  7. The Customer is obliged to return the goods to the Seller promptly, no later than 14 days from the date of withdrawal. It is sufficient to send the goods before this deadline expires.
  8. The direct cost of returning the goods is borne by the Customer.
  9. The Customer is liable for any diminishment in the value of the goods resulting from using them in a manner beyond what is necessary to establish the nature, characteristics and functioning of the goods.
  10. The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act, including where: the subject of the service is an item made to the Customer’s specifications or serving to satisfy their individual needs; the item deteriorates rapidly or has a short shelf life; a sealed item has been delivered and opened after delivery and cannot be returned for hygiene reasons; or digital content not recorded on a tangible medium has been delivered and its execution commenced with the Customer’s explicit consent before the withdrawal period expired.

7. Complaints and Warranties

  1. The Seller is obliged to deliver to the Customer goods free from physical and legal defects.
  2. If the goods are found to be non-conforming with the contract, the Customer has the right to lodge a complaint in accordance with the provisions of the Act of 30 May 2014 on Consumer Rights.
  3. A complaint may be submitted in writing to: GLOBTOS Sp. z o.o., ul. Legnicka 60D, 54-204 Wrocław, or electronically to: shop@globtos.com.
  4. In the complaint, the Customer should provide: contact details (first name, surname, email address or postal address); order number or other proof of purchase (e.g. receipt, invoice); description of the identified defect or non-conformity of the goods with the contract; and the Customer’s request (e.g. repair, replacement, price reduction, withdrawal from the contract).
  5. The Seller shall respond to the complaint within 14 calendar days of its receipt. Failure to respond within this period means the complaint is deemed to have been accepted as justified.
  6. A Customer exercising rights under the warranty is obliged to deliver the defective goods to the Seller at the Seller’s cost to: GLOBTOS Sp. z o.o., ul. Legnicka 60D, 54-204 Wrocław.
  7. If the goods are covered by a manufacturer’s, distributor’s or importer’s warranty, information to this effect will be included with the product or described on the Store’s website. The warranty does not exclude, limit or suspend the consumer’s rights arising from statutory warranty provisions.
  8. The Seller is not liable for damage resulting from use of the goods contrary to their intended purpose or operating instructions, nor for mechanical damage occurring after delivery of the product.

8. Personal Data Protection

  1. The controller of the personal data of Store Customers is: GLOBTOS Spółka z ograniczoną odpowiedzialnością, with its registered office at ul. Legnicka 60D, 54-204 Wrocław, entered in the register of entrepreneurs of the National Court Register under number 0000739617, NIP: 8943130424, REGON: 380742856.
  2. The Customer’s personal data is processed in accordance with applicable law, in particular with: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR); the Act of 10 May 2018 on the Protection of Personal Data; and the Act of 18 July 2002 on the Provision of Electronic Services.
  3. The Customer’s personal data is processed for the purposes of: fulfilling orders and the sales contract; managing the customer account and correspondence with the Customer; accounting and tax settlements; asserting or defending claims; and marketing purposes – based on separately granted consent.
  4. Providing personal data is voluntary but necessary to fulfil an order or create an account.
  5. The Customer has the right to: access the content of their data; rectification, erasure or restriction of processing; data portability; objection to data processing; withdrawal of consent at any time (where processing is based on consent); and to lodge a complaint with the President of the Personal Data Protection Office.
  6. Personal data may be entrusted to entities cooperating with the Controller solely to the extent necessary for order fulfilment, e.g. courier companies, payment operators, accounting firms or IT service providers – on the basis of appropriate data processing agreements.
  7. Dane osobowe nie są przekazywane poza Europejski Obszar Gospodarczy (EOG), chyba że Sklep wyraźnie poinformuje o tym użytkownika i uzyska odpowiednie zgody lub zastosuje prawne zabezpieczenia (np. standardowe klauzule umowne).

9. Intellectual Property Rights

  1. All content published in the online Store, including in particular: texts, product descriptions, photographs, graphics, logotypes, promotional materials, page layout, interface elements and software – are subject to copyright or other intellectual property rights belonging to the Seller or entities with which the Seller has concluded appropriate licence agreements.
  2. It is prohibited to copy, distribute, process, publicly disclose or use any content contained in the online Store without the prior written consent of the Seller, except in cases of permitted use provided for by law.
  3. The Customer’s use of content made available in the Store does not result in the acquisition of any rights to such content, but only grants a non-exclusive and non-transferable licence to use it to the extent necessary for proper use of the Store and fulfilment of orders.
  4. Infringement of copyright or other intellectual property rights by the Customer may result in civil and criminal liability in accordance with applicable law, in particular the Act of 4 February 1994 on Copyright and Related Rights.

10. Out-of-Court Dispute Resolution

  1. A Customer who is a Consumer may use out-of-court methods for handling complaints and pursuing claims, in particular: they may apply to the permanent arbitration consumer court operating at the Provincial Inspectorate of Trade Inspection; they may use mediation conducted by the Provincial Inspectorate of Trade Inspection; or they may submit a complaint via the EU ODR platform available at: https://ec.europa.eu/consumers/odr.
  2. Detailed information on out-of-court consumer dispute resolution methods is available on the website of the Office of Competition and Consumer Protection: https://www.uokik.gov.pl.
  3. All disputes arising between the Seller and a Customer who is not a Consumer shall be resolved by the court having local jurisdiction for the Seller’s registered office.
  4. The Seller reserves the right to amend these Terms and Conditions for valid reasons, in particular: changes in legislation affecting the content of the Terms and Conditions; changes to the Store’s offer or payment and delivery methods; or changes to the Seller’s details (e.g. address, NIP number).
  5. Amended Terms and Conditions shall enter into force on the date indicated by the Seller, not less than 7 days from the moment of their publication on the Store’s website. Orders placed before the amendments enter into force shall be governed by the Terms and Conditions in force at the time the order was placed.
  6. Matters not regulated by these Terms and Conditions shall be governed by the relevant provisions of Polish law, in particular the Civil Code, the Consumer Rights Act and the GDPR.
  7. The Terms and Conditions are available free of charge on the Store’s website in a format that allows them to be downloaded, saved and printed.
  8. These Terms and Conditions enter into force on: [01.08.2025].
